What You Need to Know About Debt Collection Defense in Connecticut
Before you proceed with your case, you should be aware of the laws that
are set in place to protect you from debt collectors' abusive tactics. The
Fair Debt Collection Practices Act (FDCPA) was passed by Congress in the late 1970's to curtail abuse
by debt collectors. The
Fair Credit Reporting Act (FCRA) is a federal law found in 15 U.S.C. § 1681 that is designed
to regulate the collection and use of consumer information by debt collectors
and creditors. The
Consumer Protection Act (TCPA)
was enacted in 1991 to restrict telephone solicitations and the use of
automated telephone equipment.
In Connecticut, the
Connecticut Unfair Trade Practices Act (CUPTA) allows an aggrieved party to legally pursue individuals or businesses
that have utilized unfair or deceptive trade practices with consumers,
including debt collection. The court can then award punitive damages,
costs, and reasonable attorney's fees to victims of unfair trade practices.
If your rights have been violated, do not wait to retain the quality representation
that our firm provides!
